Bar Grating Maintenance Liability

In 2012 a sanitation worker fell 12 feet into a vault when the bar grating he was standing on suddenly flipped over.  Bar grating systems are used throughout the country to cover vaults in sidewalks and the safety of the pedestrians must be considered.  There are rules in place, which may be different in each state, on who is liable for maintaining sidewalk grates, access panels, manhole covers and utility caps.  Knowing who is responsible for maintenance is important to any business.

The city in which this incident took place had extensive laws on who should be responsible for grating and vault cover maintenance and safety.  The company that owned the grating is to be held responsible for replacing or repairing any defective grating and should also repair any street condition that is held within 12 inches of the grating itself.  When it come to the maintenance of the rest of the sidewalk, the business that the sidewalk butts up against is liable.
